The basis on which this website is provided, and the basis on which we handle enquiries, quotations, samples and manufacturing orders.
1. About these terms
This website is operated by Guangzhou Laeyo Biotechnology Co., Ltd. ("we", "us"). By using this website you accept these terms. If you do not accept them, please do not use the site.
2. What this website is
This website describes our manufacturing services and the product categories we can produce to order. It is an introduction, not a product catalogue. Everything we make is developed and manufactured against a specific brief, and nothing on this site is an offer to sell goods from stock.
3. Quotations and specifications are not binding until confirmed
Prices, minimum order quantities, lead times and technical specifications shown or discussed on this website or in correspondence are indicative. They become binding only when we and you have both signed a quotation or order confirmation, or otherwise agreed in writing. Formula details, packaging specifications, artwork and delivery terms are confirmed at that point, not before.
Nothing on this website should be read as a price list. We do not publish prices because the cost of a cosmetic product depends on the formula, the packaging, the quantity and the destination market, and any figure given without those four variables would be misleading.
4. Information accuracy
We aim to keep the information on this website accurate and current, including our certifications, capacity figures and facility details. We may update it at any time without notice. If a detail is material to a decision you are making, ask us to confirm it in writing before you rely on it.
5. Intellectual property in this website
The text, layout, graphics and code of this website belong to us or are used with permission. You may read, print and share the pages for the purpose of evaluating us as a supplier. You may not copy substantial parts of the site into your own website or marketing material without our written permission.
6. Intellectual property in formulas and packaging
Formulas we develop against your brief, and produced for your order, are developed for you. Where a formula, base or technology was already owned by us or by a third party before your project began, that pre-existing intellectual property remains with its owner and is licensed for use in your product on the terms agreed in your order documentation.
You are responsible for any brand names, logos, artwork, claims and packaging designs you supply to us, and for holding the rights to use them. We do not reproduce another company's trademarked brand name, logo or protected packaging design. If you ask us to produce a product that imitates a competitor, we will develop our own formulation and our own packaging, and we will say so.
7. Samples
Samples are produced to let you evaluate a formulation or a packaging option before committing to bulk production. Sample production is charged separately unless agreed otherwise in writing, and sample costs are not a commitment by us to manufacture the order.
8. Regulatory responsibility
Cosmetic products are regulated differently in each market, and the requirements differ between the European Union, the United States, the Gulf states and Southeast Asia. We manufacture to the specification you approve and we will tell you what we know about the regulatory position in your market. Responsibility for the product as placed on the market — including notification, labelling in the destination market, and the role of the responsible person — rests with you as the brand owner, unless we have separately agreed in writing to take that role.
9. Limitation of liability
We provide this website as it is. We do not promise that it will be uninterrupted or free of error. To the extent permitted by law, we are not liable for indirect or consequential loss arising from your use of this website. This does not limit any liability that cannot be limited by law, and it does not affect the terms of any signed manufacturing agreement between us.
10. Links to other websites
Where this website links to another website, we do not control that site and we are not responsible for its content or its privacy practices.
11. Governing law
These terms are governed by the laws of the People's Republic of China. Disputes arising from use of this website are subject to the jurisdiction of the competent courts in Guangzhou, Guangdong. Where a signed manufacturing agreement between us specifies different governing law or jurisdiction, that agreement prevails.
